The June 8th court order blocking the $100,000 fee for H-1B visa applications has been temporarily paused to allow an appeals court to rule on a government request for a stay of the June 8 vacate decision. For the time being, USCIS is permitted to require the $100,000 fee.
June 8, 2026: A federal judge blocked the $100,000 fee for H-1B visa applications imposed by the Trump administration, determining that the administration exceeded its authority, and that the fee usurped Congress’s power to set immigration policy and taxes. Several legal challenges to this Presidential Proclamation were filed, and two other cases remain unresolved, but this is a positive development. We’ll continue to monitor this closely and will update this announcement as needed.
