On Friday, September 19, 2025, the Trump administration issued a Presidential Proclamation titled "Restriction on Entry of Certain Nonimmigrant Workers," affecting individuals in H-1B status. This Proclamation will take effect at 12:01 a.m. Eastern time on Sunday, September 21, 2025.
The Proclamation imposes several restrictions, including on:
- Entry into the United States for individuals in H-1B status, and
- Adjudication of H-1B petitions for individuals currently outside the United States.
Note: H-1B petitions filed for an extension or a change of status within the United States do not appear to be affected by this Proclamation.
Please consult with your FSIS adviser if you are in H-1B status and are planning any international travel. If you are in H-1B status but are currently outside the United States, we strongly recommend that you return before the Proclamation takes effect, if possible.
Many important details about the exact impact of the Proclamation are not yet clear.
