USCIS Issues Final Rule Modernizing H-1B Program

On 12/18/2024, USCIS issued its Final Rule titled "Modernizing H-1B Requirements, Providing Flexibility in the F–1 Program, and Program Improvements Affecting Other Nonimmigrant Workers," which is scheduled to take effect on 1/17/25. This regulation clarifies several existing technical requirements; expands F-1 OPT Cap-Gap coverage; codifies a number of existing H-1B policies and practices into the regulation itself; and provides some additional flexibility for certain sponsors. It is not anticipated that this Final Rule will affect which positions at UM may qualify for sponsorship.
