Under limited circumstances, it may be beneficial to file a new Immigrant Petition to change the beneficiary’s EB preference category from EB-2 to EB-3 or vice versa. FSIS will file such petitions whether the initial Immigrant Petition was filed by Retained Counsel or the International Center.
